What is a Bank Trust?

The “Trust” is a contract created for the benefit of a foreign buyer, made between a Mexican bank and the seller of the property in the “restricted zone” (the coasts of Mexico and the border). Foreign buyers cannot own real estate in the restricted zone, due to constitutional restrictions. The bank, as administrator, has a fiduciary obligation (Banking Obligation), to follow the instructions given by the foreign buyer, who is the beneficiary of the Trust. Is trustworthy? Yes, not at all. The buyer enjoys full property rights and the legal protection of an owner, while the bank retains title to the property. The foreign buyer has the right to use, enjoy, rent and even sell the property that remains deposited in the Trust at its market value to any eligible buyer. Trusts are established for an initial period of 50 years and can be renewed indefinitely for additional periods of 50 years.
